This Privacy Policy (hereinafter referred to as the “Policy”) governs the relations in the field of protection of personal data of visitors to the website https://ar-tal.org (hereinafter referred to as the “Website”), which is owned by the CHARITABLE ORGANIZATION “CHARITABLE FOUNDATION ‘ARTAK TOGETHER TO THE DREAM’” (EDRPOU code 44756830, registered address: 69059, Ukraine, Zaporizhzhia region, city of Zaporizhzhia, Oleksandra Hovorukhy Street, building 59a, apartment 12), duly registered in accordance with the applicable legislation of Ukraine (hereinafter referred to as the “Foundation”).

1. GENERAL PROVISIONS

1.1. In this Policy, the terms are used in the following meaning:

• personal data base – a named collection of organized personal data in electronic form and/or in the form of personal data files;

• consent of the subject of personal data – a voluntary expression of the will of an individual (provided that he is informed) to grant permission for the processing of his personal data in accordance with the formulated purpose of their processing, expressed in a form that allows a conclusion to be drawn about the granting of consent;

• processing of personal data – any action or set of actions, such as collection, registration, accumulation, storage, adaptation, modification, renewal, use and dissemination (dissemination, sale, transfer), depersonalization, destruction of personal data, including using information (automated) systems;

• personal data – information or a set of information about an identified or specifically identifiable natural person;

• personal data subject – an individual whose personal data are processed;

• third party – any person, except the subject of personal data, the controller or processor of personal data;

• cookies are small text files that are stored in the browser of a device (computer, mobile phone, etc.) after visiting a Website, and which the Website transfers to the browser. You can learn more about cookies at: https://allaboutcookies.org/.

All other terms in the Policy are used in the meaning defined by the current legislation of Ukraine, including international regulatory legal acts ratified in Ukraine.

1.2. This Policy is designed to inform personal data subjects about the processing of their personal data when visiting/using the Website, as well as to ensure the protection of their personal data during such processing.

1.3. This Policy, as well as the activities of the Foundation related to the collection, processing, storage and other lawful actions regarding personal data, are regulated by:

• The Constitution of Ukraine;

• The Law of Ukraine “On Personal Data Protection” dated 01.06.2010 No. 2287-VI;

• other current regulatory legal acts of Ukraine that regulate issues of personal data protection;

• international legal acts ratified in Ukraine.

The law (including international law), national and international regulatory legal acts regulating the protection of personal data of residents of such countries also apply to legal relations that arise in the Fund in connection with the processing of personal data of residents of foreign jurisdictions.

1.4. The owner of personal data processed in connection with visiting/using the Website options is the Fund. The Fund has the right to entrust the processing of personal data in whole or in part to third parties on the basis of a contract concluded in accordance with the requirements of applicable law.

1.5. An individual is a subject of personal data under this Policy if he or she is a visitor to the Website, including if he or she uses any options available on the Website, including providing the Foundation with information about his or her email address and name.

1.6. The Fund guarantees that:

• complies with good practices and regulatory requirements regarding the protection of personal data;

• protects the rights of personal data subjects;

• prevents the risk of security breaches in the processing of personal data.

1.7. The purpose of processing personal data obtained in the process of operating the Website is for the Foundation to carry out its statutory activities.

1.8. Posting this Policy at the link specified in clause 4.1. of this Policy is a notification to personal data subjects about the Owner, the composition and content of personal data collected in connection with visiting/using the Website, the rights of such subjects, the purpose of collecting their personal data and third parties to whom such personal data may be transferred.

2. PROCESSING OF PERSONAL DATA

2.1. The Foundation may collect and process the following information about you:

• information you provide to the Foundation: this is information about you that you provide by: using the Website and Website options, subscribing to receive email updates, providing charitable assistance (donations) using Website options, communicating with the Foundation through options available on the Website, etc.;

• information about you collected by the Website and other systems:

1) if you visit the Website, third parties may collect certain information about you and your visit, such as your browser type and version, as well as the pages on the Website that you visit, Internet Protocol (IP) address;

2) The website may also download cookies to your device;

3) if you contact the Foundation's employees via the Website or other means of electronic communication.

• information collected by third parties about you on the Website through actions: this is information about you that you provide to third parties (e.g. Facebook, Google, Twitter, etc.) by using social sharing options available on the Website, when navigating from one page to another, or by viewing materials that link (open) to other platforms (websites).

2.2. The way in which the Foundation processes your personal data depends on how you use and interact with the Website. Some information may be provided directly by you when using the Website or in other ways; other information may be collected and processed independently by the Foundation using automated technologies used on the Website.

2.3. Legal basis for data processing: when visiting the Website, the Foundation processes your personal data if

1) The Foundation has received your consent to such processing,

2) your personal data to ensure the Fund's ability to conclude and execute a transaction with you or to take steps prior to concluding a transaction,

3) in cases where the Foundation has a legitimate interest in processing your personal data and this legitimate interest does not override your interests in data protection or your fundamental rights and freedoms, and

4) in other cases specified by applicable law.

In some cases, the Foundation may have a legal obligation to process your personal data or will process your personal data for the establishment, exercise or defense of legal claims.

2.4. Automated Processing Mechanisms: The Foundation and third parties may use automated information processing technologies to process information in some sections of the Website. The Foundation uses cookies to store content and settings, which allows the Foundation to process standard information that your browser sends to certain websites you visit, such as your IP address, browser type and language, as well as the site you came from, the pages you visit and the links you click on on the Website. Having such technical information helps the Foundation improve the Website.

2.5. The Foundation may use your personal data only for the purpose and purposes specified in this Policy and applicable law, in particular (but not limited to),

1) for the purpose of processing your request (appeal) to the Fund made via the Website,

2) to ensure that you provide charitable assistance (donations) using the options available on the Website,

3) for the purpose of implementing other statutory objectives of the Fund in accordance with the procedure determined by current legislation;

4) for the purpose of sending letters and messages to your email address regarding advertising (promotional) materials, information about the start of charitable projects, requests and invitations to provide feedback on charitable activities, visiting the web resource, etc.

2.6. The Foundation may accumulate personal data processed during your visit/use of the Website, including by entering this data into a personal data database. Your personal data is stored in compliance with the requirements of current legislation in the field of personal data.

2.7. Your personal data is disseminated exclusively with your consent or in cases specified in this Policy and applicable law.

2.8. The Fund may partially publish user data on its Website in the Reporting section.

2.9. Your personal data is subject to deletion or destruction in the event of:

• expiration of the 2-year storage period or other period specified by applicable law;

• termination of the legal relationship between the personal data subject and the Fund, unless otherwise provided by law;

• in other cases specified by current legislation in the field of personal data protection.

2.10. The Foundation does not process personal data about racial or ethnic origin, political, religious or ideological beliefs, membership in political parties and trade unions, criminal convictions, as well as data concerning health, sex life, biometric or genetic data, except in cases specified by law.

3. RIGHTS OF PERSONAL DATA SUBJECTS

3.1. When visiting/using the Website, you have the right to:

• receive from the Fund information not specified in this Policy regarding the processing, conditions for providing access to your personal data, or give an appropriate instruction regarding the receipt of this information by persons authorized by you, except for cases specified by law;

• free access to your personal data;

• receive a response to a request regarding the processing of your personal data in the manner and within the time limit specified by applicable law;

• submit a reasoned request to object to the processing of your personal data, or to amend or delete your personal data if such data is processed unlawfully or is inaccurate;

• to protect their personal data from unlawful processing and accidental loss, destruction, damage due to intentional concealment, failure to provide or untimely provision, as well as to protect against the provision of information that is unreliable or defames the honor, dignity and business reputation of an individual;

• withdraw your consent to the processing of personal data; and exercise other rights specified by applicable law in the field of personal data protection.

3.2. You have the right to address any questions related to the collection, use, storage and other processing of your personal data to the Commissioner for Human Rights of the Verkhovna Rada of Ukraine, who can be contacted via the email address [email protected]. If you have any questions regarding this Policy or if you have received any unsolicited electronic notification sent by the Foundation or purporting to be sent on behalf of the Foundation, please contact the Foundation directly at [email protected].

4. CHANGES TO THE PRIVACY POLICY

4.1. The Fund reserves the right to review and amend the provisions of this Policy.
